John Rollason in his capacity as a trustee of the Dynam-ique SA Umbrella Pension Fund, Dynam-ique SA Umbrella Provident Fund, IF Umbrella Pension Fund and IF Umbrella Provident Fund failed to disclose to members that his predecessors (Ms le Grellier and Mr Lepar) had failed to pay the premiums on the Fund's indemnity cover leaving the members with no cover for the R20m spent on rebuilding the Funds' records.
Mr Rollason further tried to block the members from coming to know about this by instructing the Funds' insurer to not give any information to a former trustee named Tony Kamionsky. Mr Kamionsky then had to bring a high court action to compel the insurer to give him information on the policies. This process led to the insurer having to give Mr Kamionsky the requested information whereupon he discovered the non-payment of the insurance premiums, and he accordingly informed the members.
Mr Rollason further failed to disclose to members a material conflict of interest in that he was a colleague of Ms le Grellier working together as fellow trustees on other funds at all material times that the members were expecting him as a current trustee to hold the former trustees (which included Ms le Grellier and Mr Lepar) to account. This conflict is seemingly what led Mr Rollason shielding the former trustees from liability for their actions, in relation to the non-payment of the insurance premiums and the squandering of R20m on a fruitless rebuild of the Funds' records.
